１、原審裁判所の予測と注文について
　原審裁判所は、原決定の中で、債務者が主張した二重の交雑防止策について、「債務者の予定する前記飛散防止策により、一応、現在周辺農家において生育中の一般イネとの自然交雑の可能性はほとんどないものと考えられ」と予測し、これを理由に本野外実験を許容した（19頁４行目）。
しかし、実際には、債務者が実行した交雑防止策が「一般イネとの自然交雑の可能性をはらんだ」極めて杜撰なものであることが、現実に本件圃場を見学した天明伸浩氏の報告書（疎甲102）により明々白々となった。この点からして、本野外実験は即刻中止されるべきである。
　また、原審裁判所は、ディフェンシン耐性菌の出現について、「本件野外実験の過程で、耐性菌が飛躍的に増加」することを裏付ける疎明資料はないと判断したのみで、
「本件野外実験の過程で、債権者らの主張するように、本件圃場内にディフェンシン耐性菌が出現する可能性があるとしても、」（21頁２行目以下）
とその発生の可能性を認め、それゆえ、債務者に、引き続き、
「本件の隔離圃場内におけるディフェンシン耐性菌の発生状況と伝播の有無等)に関しては、今後とも生産者や消費者に的確に情報提供したり説明をすることにより、本件GMイネに対する不安感や不信感等を払拭するよう努めていく責任があり」（24頁３行目）
という条件を課した。
にもかかわらず、債務者は、この点に関する債権者や生産者・消費者らの質問状（疎甲103．104）に対して、
「ディフェンシン耐性菌の発生については、今回の実験の目的ではなく、調査する予定はない」
と回答した（疎甲105・106）。
　これは、原審裁判所が、こうした説明責任を十分に果たした場合に限って本野外実験は許容される（なぜなら、このあと、「仮にも、上記の情報公開等が円滑に行われず、いたずらに生産者や消費者の不安感等を助長するような事態を招」いた場合には、「本件野外実験の差止めを求められてもやむを得ない」としているからである）とした前提を債務者自らが否定するものにひとしく、この点からしても、本野外実験は中止されるほかない。

２、耐性菌問題の重要性について
本野外実験の最も重要な争点は、ディフェンシン耐性菌の出現・流出の問題であるが、ディフェンシン耐性菌に限らず、いわゆる耐性菌問題が、抗生物質の濫用により、現在、最も深刻な問題のひとつであることは、つい最近の朝日新聞の9月5日付記事（疎甲113）、2002年の日本化学療養学会の第50回総会のシンポジウム「我が国における抗菌化学療法50年の功罪」（疎甲112）や、耐性菌問題のわが国の第一人者である平松啓一氏（順天堂大学医学部細菌学教室）の著作「抗生物質が効かない」（疎甲111）などから明らかであり、本野外実験もまた、この最も深刻で厄介な問題のひとつにほかならない。

３、本裁判の国内及び国外での反響
こうした深刻な問題をはらんだ本野外実験に対しては、これを容認する原審裁判所の決定後も、全国の消費者たちから、実験中止を求める決議がなされ、債務者の下に届けられている（現在、入手した分として、疎甲107の１～５）。
のみならず、GMイネの野外実験によるディフェンシン耐性菌の出現・流出という深刻な問題は、国内のみならず、世界的に反響を呼び、本野外実験の実情を知った海外の研究者からも、問題の重要性を述べたＥメールが寄せられている（その詳細は、近日中に報告書を提出予定）。
つまり、ディフェンシン耐性菌の出現・流出という深刻な問題をはらんだ本野外実験に対しては、国内のみならず世界中から注目が集まっている。

４、予防原則について
こうした、GM技術により、いまだかつてなかったディフェンシンの常時大量の産出とこれに対するディフェンシン耐性菌の出現の可能性という事態に対しては、従来の事故の延長線上では捉え切れないものがあり、ここに、こうした新しい事故に対する新しい対応の原則である予防原則が極めて重要になる。
債権者は、この予防原則が、既に、生物多様性の保全や食品安全性の確保に関する確立した基本原則であることを明らかにする文献・映像（疎甲108～110）を提出する。また、予防原則及び、本裁判で登場する専門用語に関する基礎知識をまとめた書面を提出する（疎甲114）。
